These Terms & Conditions (“Terms”) apply to all services, classes, workshops, bootcamps, events, memberships and other activities offered under the name Europe’s Daughters (“Europe’s Daughters”, “we”, “us” or “our”).
Europe’s Daughters is the name under which the services, classes, events, memberships and other activities described in these Terms are offered.
Europe’s Daughters is currently operated by Savannah Helena Alphonso (e.U.), a sole proprietor (Einzelunternehmen) established in Germany, with its business address at Svarvargatan 20, 112 49, Stockholm, SWEDEN (“Operator”).
For the purposes of these Terms, all references to “Europe’s Daughters”, “we”, “us” or “our” refer to the activities offered under the Europe’s Daughters name and, where legally relevant, to Savannah Helena Alphonso e.U. as the Operator and contracting party.
Unless expressly stated otherwise, all contracts relating to Europe’s Daughters services are entered into with the Operator.
By booking, purchasing or participating in any Europe’s Daughters activity, you agree to these Terms.
1. About Europe’s Daughters
Europe’s Daughters provides martial arts, combat sports, fitness, educational, community and related activities. Activities may include, among other things, Muay Thai, kickboxing, boxing, fitness and conditioning exercises, partner drills, pad work, controlled contact exercises, workshops, community events and other physical or educational activities.
Individual activities may be delivered by Europe’s Daughters directly or by independent coaches, partner gyms, venues or other third-party providers.
2. Eligibility and Participation
Participants are responsible for ensuring that they are physically and mentally capable of taking part in the relevant activity.
No previous martial arts or fitness experience is required unless expressly stated in the description of a particular class or event.
Participants must follow reasonable instructions given by coaches, instructors, venue staff and organisers, particularly instructions concerning safety.
We reserve the right to refuse or discontinue a participant’s involvement in an activity where we reasonably believe that continued participation could create a safety risk for that participant or others.
3. Health and Medical Responsibility
Participation in martial arts, combat sports and physical training can be physically demanding.
Before participating, each participant is responsible for assessing whether the activity is appropriate for their individual health, fitness level, physical condition and circumstances.
Participants must inform the relevant coach before training of any injury, illness, pregnancy, medical condition or other circumstance that may reasonably affect their ability to participate safely.
Europe’s Daughters does not provide medical advice and participation in an activity is not a substitute for professional medical assessment or treatment.
Where there is any uncertainty regarding whether participation is medically appropriate, participants should seek advice from an appropriate healthcare professional before taking part.
4. Assumption of Risk
Martial arts, combat sports, fitness training and related physical activities inherently involve risks.
These may include, without limitation, bruising, strains, sprains, falls, accidental collisions, impacts, contact with other participants or equipment, and other injuries associated with physical exercise and combat sports.
By choosing to participate, participants acknowledge the nature of these activities and voluntarily accept the ordinary and inherent risks associated with them.
Participation is voluntary and at the participant’s own risk, to the extent permitted by applicable law.
Each participant remains responsible for their own actions during training and must train in a controlled manner appropriate to their experience and ability.
Participants must immediately stop an exercise and inform a coach if they feel unsafe, unwell or unable to continue.
5. Partner Training, Contact and Sparring
Many Europe’s Daughters activities involve training with another participant.
Participants are expected to respect their training partners, communicate clearly and use appropriate levels of force and intensity.
No participant is required to engage in sparring or another exercise involving a level of contact they do not wish to accept.
Where sparring or contact exercises are included, participants must follow the instructions of the coach and any applicable protective-equipment requirements.
Reckless, deliberately dangerous, aggressive or non-consensual conduct is not permitted.
6. Equipment
Participants are responsible for bringing any equipment identified as required for a particular class or event.
Where Europe’s Daughters, a coach, gym or venue provides equipment, participants are responsible for using it appropriately and following relevant instructions.
The provision of equipment does not constitute a guarantee that injury cannot occur.
7. Liability
Europe’s Daughters takes reasonable measures to provide activities in a safe and responsible manner. However, the inherent risks associated with martial arts, combat sports and physical exercise cannot be completely eliminated.
To the maximum extent permitted by applicable law, Europe’s Daughters is not liable for injury, loss or damage resulting from the ordinary and inherent risks of participating in an activity, a participant’s failure to follow instructions, inappropriate or reckless behaviour by a participant, or circumstances outside Europe’s Daughters’ reasonable control.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
Where activities take place at or are delivered in cooperation with an independent gym, studio, venue, instructor or other third party, that third party may have its own terms, safety rules and liability provisions. Participants must comply with those rules where applicable.
Participants remain responsible for their personal belongings. Europe’s Daughters is not responsible for lost, stolen or damaged personal belongings except where liability cannot legally be excluded.
8. Personal Insurance
Participants are responsible for ensuring that they have any health, accident, travel or other insurance they consider appropriate for their participation.
For events outside a participant’s country of residence, participants are particularly encouraged to check that their health and travel insurance covers the relevant sporting activities.
9. Bookings and Payments
A booking becomes binding once the booking process has been completed and, where applicable, payment has been received.
Prices and the services included in a booking are those displayed at the time of purchase.
Unless expressly stated otherwise, memberships and tickets are personal and may not be transferred to another person without our prior approval.
10. Memberships
Where a recurring membership is offered, the price, billing frequency, minimum term, cancellation arrangements and services included will be displayed before purchase.
Memberships only provide access to the classes, locations or services expressly included in the relevant membership.
Schedules, coaches and training locations may occasionally change. Reasonable changes that do not materially alter the overall nature of the membership do not automatically entitle the member to a refund.
11. Cancellations and Refunds
Cancellation and refund conditions may vary depending on the activity and will be communicated during the relevant booking process.
Unless otherwise stated, failure to attend a booked activity does not automatically create an entitlement to a refund.
Nothing in these Terms restricts mandatory consumer rights, including any statutory cancellation or withdrawal rights that apply to a particular purchase.
12. Changes and Cancellation by Europe’s Daughters
We may change the coach, venue, schedule or programme of an activity where reasonably necessary.
We may cancel or postpone an activity due to circumstances including illness, insufficient participant numbers, venue unavailability, safety concerns or circumstances outside our reasonable control.
Where we cancel an activity entirely and do not provide a reasonable replacement, participants will generally be offered a refund or credit for the affected Europe’s Daughters service.
We are not responsible for additional costs incurred by participants, such as travel or accommodation costs, except where applicable law provides otherwise.
13. Conduct and Community Standards
Europe’s Daughters aims to create a respectful and safe training environment.
Harassment, discrimination, intimidation, deliberately dangerous behaviour, sexual misconduct, repeated disregard of another participant’s boundaries, or serious disruption of a class or event will not be tolerated.
We reserve the right to remove a participant from a class, event or community, or to terminate a membership, where their conduct creates a safety risk or seriously conflicts with these standards.
14. Photography and Video
Photography or video may occasionally be taken during Europe’s Daughters activities for documentation, community or marketing purposes.
Where identifiable participants are used for promotional purposes, we will handle the relevant personal data in accordance with applicable data-protection and image-rights requirements.
Participants who do not wish to appear in photographs or videos should inform us or the relevant organiser.
Where separate consent is legally required, participation in an activity alone will not be treated as consent.
15. Third-Party Services and Venues
Europe’s Daughters may cooperate with gyms, studios, venues, instructors, ticketing providers and other independent third parties.
These third parties may operate independently from Europe’s Daughters and may impose their own terms and policies.
Unless expressly stated otherwise, Europe’s Daughters is not responsible for independently provided services outside our contractual responsibility.
16. Force Majeure and Circumstances Beyond Our Control
We are not responsible for failure or delay in providing an activity where this results from circumstances outside our reasonable control, including severe weather, transport disruption, government restrictions, venue closures or comparable events.
Where possible, we will attempt to provide a reasonable alternative.
17. Intellectual Property
Unless otherwise stated, Europe’s Daughters owns or is authorised to use the branding, written materials, training guides, graphics, photographs and other original content made available through its website and services.
Such materials may not be reproduced, commercially distributed or used for commercial purposes without prior permission.
18. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, subject to any mandatory consumer-protection provisions that apply in a participant’s country of residence.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain unaffected to the extent permitted by law.
